How to obtain the recognition of Italian citizenship by descent?
Italian citizenship, according to the Civil Code of 1865 and law n. 555 of 1912, is passed on from the Italian ancestor to their children, in connection, for unlimited generations. However, there are some restrictions regarding citizenship inherited by maternal lineage.
Jure sanguinis foresees the recognition of citizenship based on the principle of ancestry. The parent passes on citizenship to their child, regardless of where the child was born. Italian citizenship by descent is recognised for the person claiming it, through unlimited generations.
The procedure for the recognition of Italian citizenship by descent can be initiated:
- through the Italian Consulate of his/her country of residence;
- through the Italian comune where the descendant citizen has established residency.
Citizenship by descent for all of those born before 1948 of an Italian mother, is obtained through statement of claim. The appeal must be presented in Italy before the court of jurisdiction located in the area where the Italian ancestor was born.
